When this Privacy Policy mentions “Industrial KF”, “KF”, “we”, “us” or “our”, as well as the grammatical variations of the first-person plural, the reference is being made to INDÚSTRIA DE MÁQUINAS E IMPLEMENTOS AGRÍCOLAS K.F. LTDA, a private legal entity, registered under CNPJ nº 00.717.453/0001-33, headquartered at Rua Costa e Silva, nº 550, CEP 98.970-000, in the Municipality of Cândido Godoi/RS, controller of the personal data collected and processed by the website ‘https://www.industrialkf.com.br/’.

 

2. What personal data is processed?

We only process the personal data obtained through the use of the Website, always for purposes clearly indicated in this Policy and based on one of the legal grounds established by Law nº 13.709/2018. The collected data includes:

The data we collect and manage when using third-party services, such as Google Maps, are not covered by this Privacy Policy. We are not responsible for how users’ data is handled by third-party pages.

We use the data we collect in accordance with Law 13.709/18, the General Data Protection Law (LGPD), Law 12.965/2014, the Brazilian Civil Rights Framework for the Internet, and other consumer protection regulations, as well as the Brazilian Federal Constitution.

Other purposes for processing personal data may apply to Users with differentiated access, who register and are authorized in the relevant and appropriate section of the website. In these situations, the purposes will also be legitimately characterized and supported by an appropriate legal basis, especially for fulfilling contractual obligations, meeting legal/regulatory obligations, the controller’s legitimate interest, exercising rights in judicial/administrative/arbitral proceedings, consent, or another legally adequate basis.

Furthermore, it is important to highlight that:

a. All technologies used will always respect current legislation and the terms of this Privacy Policy;
b. The consent the User provides for the purposes of using data is collected individually, clearly, specifically, legitimately, and unequivocally;
c. Our Website contains links to other Websites. If the User clicks on a link maintained by third parties, they are aware they will be directed to that Website, and that their personal data will no longer be governed by this Privacy Policy. External Websites are not operated by us, and access is subject to their Terms of Use and Privacy Policy. The User should read those documents to understand how third parties process their personal data. KF has no influence over such Websites and therefore assumes no responsibility for their content, privacy policies, practices, or third-party services;
d. The User may change their consent grants for the processing of their data, provide new permissions, or withdraw consent for current permissions, being notified of the consequences that withdrawal may cause, as long as consent was the basis for collection, pursuant to Articles 7 and 11 of the LGPD;
e. Personally identifiable information will not be sold or rented by KF;
f. The User is co-responsible for the confidentiality of their personal data. Sharing passwords, logins, and access data, if generated, violates this Privacy Policy and the Website’s Terms of Use;
g. Emails requesting the User to provide registration data will not be sent;
h. Internally, the data we collect is accessed only by duly authorized professionals, respecting the principles of proportionality, necessity, and relevance for the objectives of our Website, as well as the commitment to confidentiality and preservation of privacy, under the terms of this Privacy Policy;
i. The Processing of Personal Data and Sensitive Personal Data is carried out in good faith and in compliance with the principles set forth in Article 6 of Law nº 13.709/2018;
j. The Processing of Personal Data and Sensitive Personal Data is carried out in accordance with the rules of Law nº 13.709/2018, especially Articles 7 through 16.

 

5. How long do we store your data and records?

The personal data collected and activity records will be stored in accordance with the LGPD and applicable laws, respecting the consent period of the data subject and the fulfillment of the purpose of collection. 9. Your rights

h) Information about the possibility of not providing consent and the consequences of your refusal;
i) Revocation of your consent, when provided, safeguarding the public interest that may justify the continuation of processing or the existence of another legal basis that authorizes it;
j) Objection to any processing of personal data based on one of the hypotheses in which your consent is waived, provided that non-compliance with applicable law has occurred and safeguarding the public interest that may justify the continuation of processing.

The rights must be exercised by the User in compliance with the law, reasonableness, common sense, good faith, and ethics.

10. Security

We adopt security measures, both technical and administrative, capable of protecting, as far as possible, reasonable, and feasible, personal data from unauthorized access and from accidental or unlawful situations of destruction, loss, alteration, communication, or any form of improper or unlawful processing, in accordance with the rules of Law 13.709/2018.

 

11. General Provisions

a. We do not use any type of automated decision that impacts the User.
b. We reserve the right to modify this Privacy Policy at any time, as needed, for compliance with legal provisions or regulations with equivalent legal force. It is the User’s responsibility to verify it whenever accessing the Website.
c. Updates to this Policy that require new consent collection will be notified via the User’s registered e-mail.
d. If third-party companies process any of the data we collect, they must respect the conditions set out herein and our Information Security rules.
e. If any provision of this Privacy Policy is deemed illegal or illegitimate by the authorities of the location where the User resides or connects to the Internet, the remaining conditions will remain fully valid and effective.
f. The User acknowledges that all communications carried out via e-mail (provided by the User), SMS, instant messaging applications, or any other digital, virtual, or electronic means are valid, effective, and sufficient for the disclosure of any subject relating to the services we provide, as well as the conditions of their provision or any other matter addressed herein, except as expressly provided otherwise in this Privacy Policy.
g. This Privacy Policy shall be governed and interpreted in accordance with Brazilian law, in the Portuguese language, with the Court of the Judicial District of Industrial KF’s domicile elected to settle any disputes or controversies involving this Privacy Policy, with the parties expressly waiving any other jurisdiction, no matter how privileged.

 

12. Children and Adolescents

We do not intentionally collect personal information from or about any underage individuals, whether children or adolescents. If you are underage and wish to contact us or use any functionality of this Website that requires the submission of your personal information, please ask your parents or guardians to do so on your behalf.

14. Glossary

a. PERSONAL DATA: Information related to an identified or identifiable natural person;
b. SENSITIVE PERSONAL DATA: Personal data about racial or ethnic origin, religious beliefs, political opinions, membership of a trade union or an organization of a religious, philosophical, or political nature, data concerning health or sex life, genetic or biometric data, when linked to a natural person;
c. ANONYMIZED DATA: Data relating to a subject who cannot be identified, considering the use of reasonable and available technical means at the time of its processing;
d. DATABASE: A structured set of personal data, established in one or several locations, in electronic or physical format;
e. DATA SUBJECT: Natural person to whom the personal data that are the subject of processing refer;
f. CONTROLLER: Natural or legal person, public or private, to whom decisions regarding the processing of personal data are assigned;
g. PROCESSOR: Natural or legal person, public or private, who processes personal data on behalf of the controller;
h. DATA PROTECTION OFFICER (DPO): Person appointed by the controller and processor to act as a communication channel between the controller, the data subjects, and the National Data Protection Authority (ANPD);
i. PROCESSING: Any operation carried out with personal data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination, or extraction;
j. CONSENT: Free, informed, and unequivocal expression by which the subject agrees to the processing of their personal data for a specific purpose;
l. DELETION: Elimination of data or a set of data stored in a database, regardless of the procedure used;
m. SHARED USE OF DATA: Communication, dissemination, international transfer, interconnection of personal data, or shared processing of personal databases by public bodies and entities in compliance with their legal responsibilities, or between them and private entities, reciprocally, with specific authorization, for one or more modalities of processing permitted by such public entities, or among private entities;
n. DATA PROTECTION IMPACT ASSESSMENT (DPIA): Documentation by the controller containing a description of the personal data processing activities that may pose risks to civil liberties and fundamental rights, as well as measures, safeguards, and risk mitigation mechanisms;
o. NATIONAL AUTHORITY: Public administration body responsible for ensuring, implementing, and overseeing compliance with this Law throughout the national territory;
p. PERSONAL DATA BREACH: A security violation that accidentally or unlawfully causes the destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored, or otherwise processed.
